Terms of Use

Version 2026-10-18 — effective 18 October 2026.

These Terms of Use (“Terms”) set out the rules for accessing and using the vocaway.com platform and its subdomains (“the Platform” or “the Service”). They apply to every user, whether they use the Service free of charge or under a paid plan.

Creating an account implies acceptance of these Terms. Purchases are additionally governed by the Terms of Sale.

Article 1 — Definitions

  • “Account”: the User’s personal, individual space on the Platform.
  • “User Content”: uploaded documents, transcripts of their voice, texts and other content submitted by the User.
  • “Publisher” or “Vocaway”: Mr Marceau Timbal-Duclaux de Martin--Loury, sole trader (entrepreneur individuel, EI), SIREN 999 443 013, 25 rue Broca, 75005 Paris, France.
  • “Simulation”: a job interview practice session conducted orally between the User and an artificial intelligence system playing the role of a recruiter.
  • “User”: any person who accesses the Platform and uses the Service.
  • “Institution”: a school, university, company or organisation that makes the Service available to its members (B2B offer).

Article 2 — Purpose

Vocaway is an online job interview practice service. The User speaks out loud to a recruiter simulated by artificial intelligence, which may draw on the uploaded documents (CV, job posting, cover letter); the User then receives an educational assessment report.

Article 3 — Access and registration

3.1. Minimum age

The Service is reserved for persons aged at least 15. A minor under 15 may only use it with the consent of one of the holders of parental authority, who accepts these Terms on their behalf. Vocaway may suspend an account created in breach of this rule.

3.2. Creating an account

Registration is done with an email address and a password, or with a Google account. The User provides accurate, up-to-date information and confirms their email address. It is prohibited to impersonate a third party or to create multiple accounts to circumvent the rules of the Service, in particular those relating to free credits.

3.3. Login credentials

Login credentials are personal and confidential. Any action carried out from the Account is deemed to have been carried out by the User. In the event of loss or compromise, the User must notify Vocaway without delay at contact@vocaway.com.

3.4. Technical requirements

Using the Service requires an Internet connection, a recent browser and a working microphone. Equipment and connection costs are borne by the User.

3.5. Accounts linked to an Institution

When a User joins an Institution’s cohort, certain information about their use of the Service (participation, progress, results) may be viewed by the Institution’s designated managers, under the conditions described in the Privacy Policy.

Article 4 — How the Service works

  • Simulations take place in real time: the User’s voice is recorded and transcribed, the AI responds out loud, and an assessment report is then generated (scores, strengths, areas for improvement, delivery indicators).
  • Certain features consume credits. The cost of a Simulation is displayed before it starts. Terms for purchases, subscriptions and refunds are set out in the Terms of Sale.
  • Vocaway may change the features of the Service, in particular to improve it or to comply with regulations, without substantially reducing its essential characteristics for paid plans in progress.

Article 5 — Transparency about artificial intelligence

  • The User interacts with an artificial intelligence system. The recruiter is not a real person, even if it has a name or adopts a personality.
  • The voices heard during Simulations are synthetic and generated by AI.
  • Responses, scores and advice are produced automatically by AI models (provided by Mistral AI). They may contain errors or approximations and are intended for educational purposes only: they do not constitute an official grade, a diploma, a certification or a guarantee of success.
  • The User may challenge an assessment report or request a human review by writing to contact@vocaway.com.
  • Simulation content is sent to the AI models solely to provide the Service; Vocaway requests that it not be used to train those models.

Article 6 — User obligations

The User undertakes to use the Service fairly, in accordance with its purpose and with the law. In particular, the User shall not:

  • Upload documents to which they do not hold the rights, or that contain sensitive personal data of third parties without a legal basis.
  • Circumvent the Service’s security, billing or usage-limitation measures.
  • Use bots, scripts or automated processes to access the Service or to extract content from it on a large scale.
  • Attempt to misuse the AI models (bypassing instructions, extracting internal instructions, generating unlawful content).
  • Use the Service to develop or train a competing product, or carry out reverse engineering.
  • Interfere with the operation of the Platform (overloading, denial-of-service attack, intrusion).

Article 7 — Prohibited content

It is prohibited to distribute, record or upload, including during a Simulation, any content that is:

  • Unlawful, defamatory, abusive, threatening, harassing or discriminatory, or that incites hatred or violence.
  • Pornographic, or that undermines human dignity or the protection of minors.
  • Infringing or in breach of third-party rights (copyright, trademarks, privacy, trade secrets).
  • Glorifying terrorism, crimes or offences.
  • Containing malicious software.

Article 8 — Moderation and reporting

Vocaway does not monitor User Content in advance, as it remains private. Any manifestly unlawful content can be reported to contact@vocaway.com, stating its nature and location. Vocaway handles reports diligently and may remove content, restrict a feature or suspend an Account in the event of a breach of these Terms. The User concerned is informed of the measure and the reasons for it, unless otherwise required by law, and may challenge it by email.

Article 9 — Intellectual property

9.1. Vocaway’s rights

The Platform, its software, interfaces, trademarks, logos, interview frameworks, assessment grids and editorial content are the exclusive property of the Publisher or its licensors. Vocaway grants the User a personal, non-exclusive and non-transferable right to use the Service for the lifetime of their Account.

9.2. User’s rights

The User retains all their rights to the documents they upload and to their transcribed words. They grant Vocaway a limited, non-exclusive, royalty-free and revocable licence, valid only for as long as necessary, to host, reproduce, transcribe and process this content for the sole purpose of operating the Service (Simulations, reports, history, export). Vocaway does not publish it, sell it or use it for any other purpose.

The assessment reports generated for the User may be freely used by them for personal or professional purposes.

Article 10 — Personal data

The processing of personal data in connection with the Service is described in the Privacy Policy and the use of trackers in the Cookie Policy.

Article 11 — Liability

Vocaway is bound by an obligation of means (best efforts). It endeavours to ensure the availability of the Service but cannot guarantee that it will be free from interruptions, in particular for maintenance, in the event of failure of networks or of its technical service providers, or in the event of force majeure (Article 1218 of the French Civil Code).

Vocaway cannot be held liable for the use the User makes of the advice produced by the AI, nor for the outcome of any real job interview or recruitment process. The User is responsible for the content they upload or say.

Nothing in these Terms limits the rights that a consumer User derives from mandatory statutory provisions.

Article 12 — Suspension and termination

12.1. By the User

The User may delete their Account at any time from Settings. Deletion becomes permanent after a 30-day grace period, during which it can be cancelled. Active subscriptions must be cancelled in accordance with the Terms of Sale.

12.2. By Vocaway

In the event of a serious breach of these Terms (fraud, prohibited content, security breach, non-payment), Vocaway may suspend access to the Account, after informing the User except in urgent cases, and then terminate it if the breach persists. Individual and student accounts inactive for 3 years, with no ongoing subscription, are deleted after a warning email sent 30 days in advance.

Article 13 — Changes to the Terms

Vocaway may amend these Terms. The version in force and its date appear at the top of this page. Any substantial change is notified to the User by email or in their account area at least 30 days before it takes effect. A User who does not accept the new terms may delete their Account before that date; otherwise, continued use of the Service constitutes acceptance.

Article 14 — Miscellaneous

If any provision of these Terms is held to be void, the remaining provisions remain in force. Vocaway’s failure to invoke a breach does not constitute a waiver of its right to invoke it later.

Article 15 — Governing law and disputes

These Terms are governed by French law.

In the event of a problem, the User is invited to contact Vocaway first at contact@vocaway.com in order to seek an amicable solution. A consumer User may also use, free of charge, the consumer mediator designated in the Terms of Sale.

  • Consumer User: the dispute is brought before the court with territorial jurisdiction under the rules of the French Code of Civil Procedure and the French Consumer Code; the User retains the protection of the mandatory provisions of the law of their country of residence.
  • Business User: exclusive jurisdiction of the courts with authority over the Publisher’s place of business.
